Chapter V Legal Responsibility

县级以上部门和质量技术监督部门32省人民政府应当在各自职权范围,加强节能和能源的质量认证标志的效率确定使用的监督和检查,结果为市民。
任何单位和个人不得使用伪造的节能质量认证标志和能源效率标识,或冒用能源节能质量认证标志,和能源效率标识。第33届能源部省人民政府,质量和生产过程的技术监督部门联合制定的单位产品能耗较高的产品能耗限额标准公开。

第五章法律责任
第三十七条违反本条例第十二条第一款规定,建筑物的设计未能能源强制性国家标准节能型建筑结构,材料,设备和产品,由县级以上人民政府责令限期在设计单位负责建设的部门,不正确的给予警告,处10万元以上三十点零零零万元以下的罚款;造成损失的,依法赔偿责任。
未能设计与兴建建筑物的能源需求,节能建筑结构,材料,设备和产品,县级以上人民政府建设部门,应在规定的建设期限下令工程合约单位价格超过2%4%以下的罚款;情节严重的,责令停业整顿,降低或撤销资格等级资格证书。
第三十八条违反本条例,电力,煤气,天然气,煤炭,能源生产,经营单位,十六的规定,该单位工作人员和其他居民免费,低成本的能源产品或者实行包费制由县级以上人民政府责令限期能源部逾期改正,处1万元以上5万元以下的罚款。
第39次违反本条例第26条第二款规定进行节能的虚假数据和分析报告提供监测技术服务机构,以及县级以上人民政府责令正确的节能部门,予以警告,情节严重的,可以处以一万元以下2000元以下的罚款。
40第三十一条违反本条例的条文已被监测单位拒绝县级以上人民政府有关部门监测责令限期改正节能,并告知。
第四十一条第32条对本,伪造的质量,能源使用条例节能和能效标识认证标志,或冒用能源节约和能源效率的质量认证,违反规定的第二段马克县级以上人民政府质量技术监督部门责令改正,没收违法所得徽标,您可以对以上5倍违法所得以下的罚款。
第42次拒绝,阻碍节能公安机关的执法人员开展违反“法律和秩序,人民的中国处罚法共和国的公共职责”依法,构成犯罪的,依法依法追究刑事责任。
